Another Motorcycle Death in Myrtle Beach

There is yet another death related to the Myrtle Beach bike week events. Last night a motorcycle rider was killed near the intersection of 501 and Robert Grissom Parkway. The accident is still under investigation and no charges have been filed by law enforcement as yet. This brings the total number of motorcycle related deaths to 5 in the past thirty days. There appear to be more people attending the bike events this year because of the demise of the helmet law by the South Carolina Supreme Court. Most of the deaths this year were caused by the motorcycle rider, but at least one so far was caused by the drunk driving of a local resident. This individual has been charged and will face a significant amount of prison time. He was a retired law enforcement officer and refused to provide a breath sample at the time of the incident. Based on the severity of the accident the police were allowed to withdraw a blood sample from him to exam the alcohol content.
Our Myrtle Beach law firm has represented several families of DUI victims over the years. Most of these deaths are caused by simple neglect, but some are the result of an individual who is an alcoholic and has finally caused the ultimate damage. A good lawyer in Myrtle Beach can help with the coping and handle the legal side of the case.

Arnold Schwarzenegger's Divorce

Arnold Schwarzenegger and his wife of 25 years, Maria Shriver, are about to start divorce proceedings very soon. Recently, rumors started surfacing accusing Arnold of having an affair and fathering a son with former housekeeper Mildred Baena. Although Arnold and Maria have a prenuptial agreement in place, it may be considered void due to his infidelity and the duration of their marriage.

The housekeeper was once married, and her now ex-husband thought the child belonged to him! Due to the fact that Schwarzenegger kept the child a secret from so many people for such a long time, the public may now view him as a liar. His family feels very betrayed, so much so that one of his sons has dropped his dad's famous last name and changed it to his mother's last name.

Schwarzenegger and Shriver have assets estimated between $200 million and $400 million. They will likely share that sum evenly. They will also likely need to hire a family law attorney to move forward with their divorce.

Another Bike Week Death

Another motorcyclist was killed over the weekend. The 22-year-old man from Jamestown, Jacob Miller, died of head trauma after an SUV turned in front of his motorcycle. The driver of the SUV is under the age of 18, so his name is not being released. Miller was the third motorcyclist killed during this year's Myrtle Beach bike rally.

The motorcycle accident last week involving the ex-police officer has made headlines again. Larry Hardee has formally been charged with felony driving under the influence with death results. Hardee was released on $20,000 bail and is expected to appear in court around the end of July.

Atlantic Beach bike week is set to begin soon. Hopefully everyone will share the road with this group of bikers set to enter the area for the Memorial Day holiday. A few years ago , a Coastal Carolina student was shot and killed over a parking space during a crowded weekend of the Atlantic Beach Memorial Day Bikefest. That incident only added fuel to the fire for residents of the city who have negative opinions about annual motorcycle festivals.

Bike Week Deaths

Tuesday night around 6 p.m., a former Myrtle Beach police officer killed a motorcyclist in North Myrtle Beach. The officer, Larry Hardee, is currently being held in jail and is facing a felony driving under the influence charge. As a result of the crash, the motorcyclist, Rocky Honeycutt of North Carolina, died of head and chest injuries after he was transported from the scene to Seacost Medical Center.

The former officer was taken to the North Myrtle Beach jail following the motorcycle crash, but refused to take a breathalyzer test. To determine his blood alcohol content, Hardee was taken to a hospital to have his blood drawn. He is currently being held at J. Reuben Long Detention Center outside of Conway to await his bond hearing.

On Monday night, Robert Dew of Loris was killed when he crashed his motorcycle into another motorcycle driven by one of his relatives. Dew died at the scene of the accident due to head and internal injuries; he was not wearing a helmet. His relative who was also involved in the crash was flown to Grand Strand Regional Medical Center and is listed in fair condition with no life-threatening injuries.

Myrtle Beach Bike Week

Bike Week has officially started in Myrtle Beach. Bikers from all over the US have flocked to the area to cruise the streets on their motorcycles. Since the Myrtle Beach helmet law was overturned, some bikers choose to forego their helmets and let their hair blow in the breeze. There are plenty of risks involved when bikers choose to live on the wild side. It seems like every year, someone gets injured or killed during bike week, and it isn't always bikers.

In fact, a man is filing a personal injury lawsuit against Horry County and the town of Atlantic Beach because the county failed to maintain control of public roads during the bike rally in 2006. An Atlantic Beach resident called 911 to get his wife medical help and she ended up dying on the way to the hospital. The suit states, "That as a direct result of the defendant’s (Atlantic Beach and Horry County) lack of crowd and traffic control, the plaintiff failed to receive emergency medical treatment in a timely fashion thus causing her to undergo much physical pain and suffering.”

Motorists should be very cautious when driving during the bike rally. Always check blind spots when passing motorcycles and other vehicles. According to SCNow.com, "Most motorcycle deaths in South Carolina result from failure to yield on the part of either the motorcyclist or vehicle. The collision is often complicated by the motorcyclist’s speed and/or failure to use a helmet."

Botox Mom

San Francisco's Kerry Campbell, also known as the Botox Mom, has reportedly lost custody of her 8-year-old daughter. Campbell admitted that she gives her daughter the anti-wrinkle injections to help her win a beauty pageant. According to TMZ.com, "Campbell went on Good Morning America and told the world she gave her daughter the injections herself." Whats even more disturbing is that the daughter has already told people that she is looking forward to having a nose job and breast augmentation so she can become a star sooner! Campbell is now under investigation by Child Protective Services.

Even though San Francisco's child protective services intervened in this high-profile case, it seems there are no criminal laws specifically prohibiting these types of procedures for children, as the industry is self-regulated. This investigation doesn't necessarily mean that Campbell will lose custody of her child for a long time. Campbell may be able to regain custody by meeting certain conditions such as a parenting class, counseling and supervised visits.

Park Injuries

Thinking about heading to Disney World with the family this summer? One family who went last summer filed a personal injury lawsuit against the theme park because their 4-year-old's face and lips were burned by hot nacho cheese sauce. According to the complaint, the park failed to regulate and monitor the temperature of the cheese, which resulted in the child's burns.

In fact, a lot of personal injury lawsuits against theme parks have nothing to do with the parks signiture attractions such as roller coasters and other rides. The most common lawsuit is the simple slip and fall. Here are a couple examples: a man from Virginia sued Disney World for food poisoning which caused him to gag so hard that he ruptured his esophagus. Also, a woman from Hawaii sued Busch Gardens because she allegedly contracted a rare blood disease when a vulture from a trained-bird show clawed at her legs.

Khloe and Lamar

Due to a recent Lakers loss, Khloe Kardashian and Lamar Odom's reality television show is under scrutiny. On-lookers are commenting that the show is having a negative effect on Odom's performance on the basketball court. MSN.com reports, "After a crushing loss to the Dallas Mavericks, ending the Lakers' run in the playoffs, Odom was specifically criticized for his uncharacteristic foul against the Mavericks' Dirk Nowitzki. Odom previously told the Los Angeles Times that the reality show demands were extremely tough but that his life was too boring in the off-season to warrant a camera crew."

Lets not forget what happend to Jessica Simpson and Tony Romo of the Dallas Cowboys. Although the two weren't married, Simpson was blamed repeatedly for Romo's slip-ups on the football field. It seemed as though he was too love-struck to make any plays!

What if Odom decides to withdraw from the show? That may cause a problem in his marriage. Since the pair only dated for a month before tying the knot, it wouldn't surprise anyone if they ended their marriage just as quickly. If they did split up, both of them may need a good divorce attorney. If you or someone you know is ready to get a divorce, please call one of the Myrtle Beach family law attorneys at The Mace Firm.

Sporting Event Injuries

This week, a woman who works for the Dallas Cowboys filed a personal injury lawsuit over the 2009 collapse of one of the team's practice facilities. Apparently, the woman suffered injuries when the building collapsed during a wind storm in May 2009. The collapse of the practice facility also caused serious injuries to many other Cowboys personnel. One person was even paralyzed from the waist down due to the incident.

Even spectators can be injured at sporting events. Imagine attending a hockey game and being injured by the puck. Or think about the chances of going to a baseball game and being hit by a foul ball. One study found that this happens at a rate of about 35 injuries per million spectator visits. Injuries can happen at any type of sporting event, but research has shown that they are most common at baseball and hockey games.

South Carolina Family Court

South Carolina was the last state in the US to allow divorce. In 1969, this state decided to allow a couple to get a divorce if they have lived separate and apart for at least three years. Ten years following that, the time period was amended to one year. Getting a divorce does not always mean that you will have to go to court. When a settlement is impossible, they will typically take their case to trial. A trial in family court requires that a judge hear witnesses and receive evidence from the plaintiff and the defendant. Depending on the complexity of the issues in the case, a trial may last only one day or up to several weeks.

After trial, the divorce attorney will prepare proposed orders for the judge. Until the final order and the decree of divorce are issued, the parties involved will remain under the temporary order. If someone is dissatisfied with the final order, they have 30 days to appeal it. A family law appeal is a lengthy process which includes more costs and work for everyone involved..
