Fatal Crash Investigation Concluded in New York

The driver, Diane Shuler, was driving her van around 85 mph and on the wrong side of the roadway when she collided with an SUV. Shuler killed herself, her daughter, three nieces and three men in the SUV. The only survivor was her 5 year old son. The case drew national attention because it was discovered that this woman had consumed alcohol and marijuana prior to driving the van with all the children. This type fatal car accident is not uncommon in South Carolina. Danny Shuler, the surviving husband of Diane, has been the center of attention for defending his wife after the accident. There is are many arguments from victims of these cases that they are not really accidents. A tire did not just blow out and cause this accident, Diane did not have a seizure, a child in the car did not grab the wheel. Family members of victims see a person commit an act that was preventable at many different levels. Not drinking and driving is a big issue that could have been avoided by the simple act of not driving or not drinking. DUI related deaths are still occurring on a daily basis in South Carolina. Our Myrtle Beach Injury Attorneys have represented many families who have been victims of such accidents. The DUI laws of South Carolina were some of the weakest in the Nation several years ago. Recently, the South Carolina Legislator amended the DUI statue to increase the penalties for a conviction.
Representing a family after the loss of someone close is not always easy for the attorney or law firm support staff. We end up becoming close friends with our clients during the pendency of the case. The first days, weeks and month are the most difficult to handle for family. Annual holidays are always difficult. We have seen that most families recover best through activity or work. The worst times are when people are alone or when things are very calm. Our lawyers in Myrtle Beach understand the process and can help with the representation of the family during a lawsuit.

Marital Debt: Who is Reponsible?

Under South Carolina law, debt that is incurred during a marriage is presumed to be marital debt. These debts will be equitably divided between both parties. Although the debt is usually divided equally between both parties, the court is not obligated to divide everything 50/50. The court will look at contributions made by each party, the length of the marriage, if there was any marital misconduct by either person, and many other factors.

Bike Week ends in Myrtle Beach

With the Atlantic Beach Bikefest wrapped up for 2010, and Bikeweek also completed earlier this month, Myrtle Beach’s influx of bikers has died down. New biker laws that were introduced around two years ago are said to have had an impact on this year’s attendance. The new laws include a noise ordinance law and a helmet law within the city of Myrtle Beach. Many businesses in the Myrtle Beach area claimed that these laws affected the turnout for both bike weeks, which in turn affected their sales. But with bike week there is always the risk of accidents, with such a large number of bikers on the road their was bound to be a few. Their was a fatality on Myrtle Beach roads a few weeks ago.

Consulting a good civil lawyer after a motorcycle accident is always a good idea, so that you can receive the compensation that you deserve. The Dream Act

The Dream Act, what is it? The Dream Act is aimed at providing a solution to those who are classified as ‘illegal immigrants’. The Act is intended to deliver a reasonable way for illegal’s that entered the country when they were fifteen or under. If they graduated high school, they can then go on a six year path to citizenship. This path includes either the completion of a college degree or two years of military service. This is set to benefit approximately 65,000 high school graduates every year in the United States. The Dream Act has not passed in Congress yet, but many continue to lobby for it to be introduced. Some have any protested in New York for its introduction. A lot of people feel very strongly about illegal immigrants, on both sides of the spectrum.

The Dream Act will enable many people to start a path to citizenship, where there was not one for them before. If this Act is passed, it will open the floodgates for green card applications in the United States. Those who wish to apply should consult an immigration lawyer to handle their applications. A good immigration lawyer located in Myrtle Beach, Nicole Mace handles immigration cases, both for permanent residency and naturalization. Nicole Mace can be reached at (843) 839-2900.
